Habitual Offender Arrested After Loudon Road Crash: Concord Police Log

CONCORD, NH — Madeline Elizabeth Smith, born 1989, of Concord was arrested at 12:57 p.m. on March 26, 2023, on falsifying physical evidence, disorderly conduct, and resisting arrest or detention charges. Brian D. Call, born 1982, of Pittsfield was arrested on a bench warrant at 1:35 p.m. on March 25 after an incident on Loudon Road.

Stephen Scherber, 32, of Concord was arrested on a warrant at 1:23 p.m. on March 25 after an incident at the Royal Gardens apartment complex. He was charged again on another bench warrant at 1:45 p.m. Scherber was arrested again at 2 p.m. on March 25 on a warrant and four bench warrants.

Adam S. Dyer, born 1981, of Franconia was cited at 1:05 p.m. on March 25 on a driving after revocation or suspension charge after an incident on Water Street.

Joseph Aaron Hamel, 40, of Concord received a summons at noon on March 25 on a driving after revocation or suspension-subsequent charge after an incident on Hall Street.

Amber R. Belmain, 35, of Nashua was arrested on a bench warrant at 8:45 a.m. on March 25 as well as a driving after revocation or suspension charge after an incident at Speedway on Hall Street.

Zachary L. Alden, 29, of Bow was arrested at 7:17 p.m. on March 25 on a warrant after an incident at Tru by Hilton on South Main Street.

Nathaniel Joseph Bergeron, 26, of Elm Street in Pittsfield was arrested at 10:04 p.m. on March 17 on a felony habitual offender charge as well as misuse of plates and traffic control violations. Officers were sent to Loudon Road in the area of the Aldi supermarket for a report a vehicle and motorcycle colliding. The roadway was closed down and the driver of the Honda was questioned about the crash. She said she was OK, according to a report. The reporting officer could not find the motorcyclist, but the woman pointed to an area by Aldi and said he was there. The officer spoke to the motorcyclist, Bergeron, who said he had a shattered right arm that was numb and could not move it although he was not feeling any pain, an affidavit stated. Dispatch said Bergeron was a habitual offender since June 2021, and fire and rescue teams took him to Concord Hospital. Bergeron's girlfriend, who was at the scene, was questioned about what happened. She said he was having problems with the bike with a fuse at the 7-Eleven but was able to get it restarted. She was traveling behind him in a truck when a vehicle pulled out of the Steeplegate Mall parking lot, running a red light, and he drove into the vehicle, the affidavit said. At the hospital, Bergeron said his friend was riding the motorcycle but was having issues with it and left it at 7-Eleven for him to pick up. Bergeron said 7-Eleven would not allow him to leave the motorcycle there until he could get a tow. He was able to get it restarted and was in the process of riding it to Walmart to park overnight before the crash. Bergeron, on Loudon Road, attempted to speed up to try and beat the yellow light at the intersection, the report said. As the other vehicle pulled into the intersection, he tried to brake but struck the other vehicle, the report stated. The report said Bergeron asked the other driver if she was OK and realized he could not move his right arm. Bergeron said, "I know I f----- up," admitting to driving while being a habitual offender, the affidavit said. According to the officer, the plate on the motorcycle was for a 2005 Harley-Davidson, but the VIN on the bike involved in the crash was a 2009 Kawasaki. Bergeron, the officer wrote, was convicted of drunken driving in November 2017 in Concord District Court. A second officer spoke to the driver of the Honda, which had a Florida registration, who said she pulled out after the light turned green and saw the motorcycle "driving at an incredibly fast speed" before the crash, the report said. Raymond J. Hastings, 40, a homeless man now located in Concord, was arrested at 5:27 a.m. on March 16 on a felony drug possession charge and loitering or prowling charges. Officers were sent to the Durgin Block Parking Garage on School Street for a report of two people, possibly using drugs, near an elevator on the top floor. Later, the men took the elevator to the bottom of the garage and the officers met them there. During questioning, Hastings and another homeless man, Robert Clark, said they were "smoking cigarettes" and "staying warm," the affidavit said. Later, Clark admitted they were lying, an affidavit stated. He said they had found tinfoil on the ground in the garage with fentanyl on it, so they smoked it, a report said. Both were then arrested for prowling. Hastings, however, was accused of having a baggie inside his right side jacket pocket with off-white, tan-colored powder believed to be fentanyl. He was released on bail on March 29 but failed to appear at his arraignment in Merrimack County Superior Court on April 6.

Johnathon Joseph Hutchins, 31, a homeless man now located in Concord, was arrested at 4:33 p.m. on March 12 on a felony possession of a controlled drug charge. Police were sent to The Draft on South Main Street for a report of a man, not wearing a shirt, putting his hands in his pants, and acting strangely. At one point, the caller said the man was chasing people down the street. A second caller reported an assault in the progress. The reporting officer found the man, later identified as Hutchins, on South Main Street with another man walking away from the scene. The officer spoke with Hutchins and accused him of having suboxone strips in his hand. He was asked if he had a prescription but said they belonged to the man who walked away, the affidavit said. Since he was unable to produce a prescription, Hutchins was arrested. According to superior court records, he was released on bail, and a dispositional conference hearing was held on March 28. He failed to appear at his Merrimack County Superior Court arraignment on March 30.
